2006 Retrospective - some articles repeated from previous issues, references to links may not apply

I really don't like the year-in-review thing, but enough subscribers want this that I will break loose with my thoughts and opinions. Now remember you asked for this!

January started out with the recovery efforts due to Wilma's flood surge. Gail Kenson was still around and briefed the council on upcoming renovations to the Boat House property. Jolly Roger residents were out in force hoping for help from the city. There were lots of cool plans that have yet to result in cool results. Randy Mearns is quoted, "Government moves at the pace of a dead snake!" David Rice is still a county commissioner.

In February, city council elections were heating up. Our endorsements turned out to be true for Bull and Tempest. Bob Miller had way too much unasked for help. The ad that came from a PAC showing Worthington and Tempest signs in the hands of Repetto led to a Worthington win for all the wrong reasons. The Middle Keys Community Land Trust were in negotiations with Islamorada to partner in workforce housing solutions. Eventually, the Land Trust would contract with both Islamorada and Marathon.

Rick Servais, the opportunistic owner of the new Dockside, accused former Marathon Mayor Jeff Pinkus of being influenced by his Cay Club employment. Servais wrote a letter to the Florida Commission on Ethics, but the letter was not a formal complaint. Anyone who closely follows the local political scene knows that Jeff Pinkus is the last person on the council who could be influenced. Jeff Pinkus has stood up to developers time and again and continues to require them to pay their way to mitigate the impacts that they have on the city. Whatever motivates Rick Servais is immaterial, this is just more of the same slimly politics we have come to recognize and laugh at. Rick Servais has made himself transparently puerile and simply ridiculous.

In March, the sewer and stormwater systems were progressing at a rapid pace. The council had several wastewater/stormwater issues to discuss and make decisions on at least 6 of the 9-item list. As always, Project Manager Susie Thomas was well prepared. She provided a handout that the clearly and concisely outlined the choices, making the process easy and simple. When things need to get done, just call on Susie. The Sombrero Beach Road project in front of the Sombrero Beach Park drew a lot of resident discussion and a few council workshops. Susie was managing this project as well. The Land Trust manages its first resale of a two-bedroom, two-bath townhome. There were over 40 applicants for one home.

April saw Chris Bull taking over mayoral duties from John Bartus. John Bartus has been our councilman all six years of the city’s existence and is being termed out. He has been mayor twice and one of our best mayors. John is the face of Marathon and has served the citizens in an exemplary manner. John loves and cares for the city and its citizens. We hope that this is not the last time we see John as our mayor. Until then, we bid farewell to our Mayor. Thanks, John! The Florida Keys Marathon Airport Task Force struggled to get regional jet service to our fair city. FIRM begins to make a splash throughout Florida over Citizen's Insurance.

May saw the city and the firefighters get grittier with each other. The issue over volunteer firefighters and the union is not the only one, but that is the issue that tops the list. Boot Key Harbor and Marina are improving every month. The marina is paying for itself now without a city subsidy out of taxpayers' pockets.

Marlin Bay Yacht Club, Sandler at Greater Marathon Bay, and Gulfstream evictees are all involved in the establishment of a new office. This new suite is located at 3980 Overseas Highway at the new three-suite office facility just recently built. 3rd Generation Plumbing is a tenant as well as the Sandler folks. 3rd Generation never harassed anyone like Eugene Spano and Jay Pulis did. In fact, 3rd Generation Plumbing was quite helpful in trying to locate any Sandler office personnel.

Several calls over the last week or so from interested parties finally got us to go out and take some pictures of the new Marlin Bay Yacht Club offices. April 7th it was, but the occupants had a short day and returned to Miami. We will have to come back to talk with them. Several attempts were made to contact the office dwellers, but they never seem to be there. We tried in the morning, the afternoon, and the evening on several occasions.

We would like to ask them if all those people they harassed and evicted could come back and get one of the 18 affordable units that they promised the city they were going to build first. We have talked with hundreds of people who were appalled that Sandler at Greater Marathon Bay would stoop to threatening to sue the citizens of Marathon. And, frankly, Sandler at Greater Marathon Bay treated Marathon citizens quite shabbily and evicted residents in a manner no developer has since contemplated.


You all remember the Gulfstream people? They were neighbors and citizens and friends and fellow workers, colleagues, you remember them, don't you?

VA Entitlements
When I joined the Navy in 1970, I was promised that the Navy would take care of me and mine. This was especially the case, if you made a career out of the service. I did that for over 25 years, until I retired in late 1995.

All along those 25 years, several armed conflicts, wars, and other actions, I was continually promised by one and all that the service would take care of its own. That is not necessarily the case.

First, you have people who begrudge service members their entitlements and services for which service people worked, died, and were wounded for. I say that we earned it. We were promised this as one enticement to put our lives on the line for our country. So any complaints to the contrary are irrelevant.

Secondly, roadblocks and bureaucratic land mines are placed in service members' way to just get minimal services and entitlements. This should not be the case. Obviously, we need to weed out the very few cheaters, but the great majority of us deserve timely and quality services.


I have several disabilities that are service connected. I had to fight and continue to do so to get services and entitlements to which I am due and have earned. I have finally got 50% disability, but should have 100% because I can no longer work. I will continue to fight to get what I am owed.

I shouldn't have to do this, but it is another price service members must endure.

June saw Chappie’s Restaurant major conditional use to develop the restaurant, swimming pool, deck/patio area, and parking lot at Kyle Way West on Knights Key near mile-marker 47 was approved. Craig Company Tom Williams addressed a last minute resident request to continue this item. This resident wanted a gate. If the council permitted the gate, the applicant would be happy to comply. John Herin stated that a gate could be permitted under specific state guidelines or abandon right of way. Abandon the right of way would not likely get the approval of every resident. John Chaplin spoke of trying to satisfy all the residents. Continuance was denied. Cay Clubs supported the development. The major conditional use was approved.

Former city council candidate Don Kenny is leaving the Florida Keys. In a meeting with Don Kenny May 22nd, he told the story of his decision to finally leave paradise. He can't afford paradise anymore, but he can travel. Don is a disabled veteran, coping as best as he can. When the opportunity came up to travel to various national parks, he couldn't pass that up. Don has a friend going with him to assist if needed. There are many of us that hate to see Don leave, but we all understand. Fair seas and following winds, Don. Be good.

Marlin Bay Yacht Club is housed in offices next to the 3rd Generation Plumbing office near 35th Street. We took pictures and posted them. Several efforts were made to interview anyone at this Sandler at Greater Marathon Bay company. To date, no one has returned the invite for an interview or called. This is typical of a company famous for evicting city citizens. Currently the old Gulfstream and fishery property has activity. Seawalls are being built with the help of a large crane with an American flag flying atop the machine. Of course, all the veterans that lived there near 37th Street and Louisa are gone, having been evicted.

After occasional turbulences through the years, the City of Marathon's staff has just gotten better with the departure of Harry DeLashmutt, formerly Ports Manager, Gail Kenson, formerly Planning Director, and Cindy Echlund, formerly City Clerk. Harry was a loose canon. He wasn't good with the public and even worse with his employees. Gail was a roadblock to any real progress on workforce housing. She wasn't very good with the general public either, unless you were a high-priced developer. Cindy represents the worst of the few staffers who believed that they could outwait any council member or city manager. She was an elitist who thought she knew all the answers from city hall to her very own homeowner association. How wrong she was!


Two articles have appeared in the Marathon Free Press about the American Legion Post 154. I am a lifetime member. I go there to be with veterans and like-minded people. I enjoy the scheduled events. A silly internal squabble over a fishing tournament somehow became news fodder. To those officers and members involved, shame on you. Use some common sense and get along. The Free Press should know better. Shame on them too!

In July the new Marlin Bay Yacht Club perpetrated upon an unsuspecting Marathon citizenry and lowly evictees by the nefarious Sandler at Greater Marathon Bay is finally under construction. A brand new black-caped fence surrounds the property that used to be home to good citizens of Marathon. Seawalls are being constructed. Attempts for an interview still go unanswered.

Old Pete ran on a platform of reformed ideas, but the Repetto clone came to the forefront once again. He talked about issues and figures that applied years ago. The issue has matured since his stint on the council. Council members tried to reason with Worthington, but he was adamant that the city is not capable of building and staffing a new fire/rescue station and city hall plus addressing workforce housing issues. And at the same time move the community swimming pool project along the process began years ago. Councilman Worthington must think the staff incapable and the citizens about to riot. Frankly, city staff is more than capable. And the Master Plan is full of consistent requests for a community park and a community swimming pool. Many of us had hoped that Pete Worthington had changed his colors, but sadly that doesn't appear to be the case. Let us hope reason prevails at future meetings.

August Journal - the Nears Shore Waters Advisory Committee met July 6th at the Marathon Public Library. Chairman George Garrett gave an update on the city - county efforts to remove shallow traps, vessels, debris, and trash. Harbormaster Richard Tanner reported on the new mooring fields. The invitation to bid will be ready very soon. The project should be done in mid-November. There was discussion on possibly doing an open house, a PowerPoint presentation, a brochure, and boat rides to introduce the community to the new Boot Key Harbor.

September - Tom Oosterhoudt's Conch Color is a photographic chronicle that is published weekly from Key West to Marathon. The former city commissioner takes his skills to his weekly. The photographs are always top notch. The stories are fresh and charming. His Out & About is classic. There is a zest for living in every page and human emotions in every photograph. There is a keys spirit throughout the weekly. This publication is a classy addition to the news organizations in the Florida Keys. Congratulations to Tom and his growing staff.

October Journal - The Marathon Code Board convened September 13 at the Sheriff's Aviation Hangar second-floor training room. Board members are Chris Gratton, Kevin Woodland, Kay Gradick, Bill Hough, and Ed Torella. Councilwoman Marilyn Tempest was also in attendance.

Alice Charlton and Willy Turza, owners of 6099 Overseas Highway Lot 47W in Keys RV/Mobile Home Park, were cited for construction in progress without the benefit of a permit. The owner requested a continuance, which was denied. Code Inspect Michael Storm presented the case to the board. The board found the owners in violation and tasked them to come into compliance in 60 days.

Sandler at Greater Marathon Bay's Marlin Bay Yacht Club owns land that the former Gulfstream Trailer Park community was located. Eugene Spano, Sandra Walters, and Jay Pulis and their ilk might think that the dishonorably evicted former residents might forget. They have not forgotten. Many are still Marathon citizens and rabid voters. Sandler might think the citizens and voters of Marathon might forget and forgive. They have not forgotten nor forgiven the despicable episode. Florida Keys Journal will keep the memory alive.

November - The Marathon Parks and Recreation Advisory Committee met October 12 at the Marathon Public Library.

Councilwoman Tempest attended the meeting. Several members of the public were there as well, including a group from the Sk8 Club.

Marathon Parks & Recreation Supervisor Jimmy Schmidt gave an update on the batting cage. The cage, poles, and other equipment arrived. Building permit is in place. They will dig the holes next week.

Coral Construction starts the installation of the shade structure to the Skate Park on Tuesday.

Coco Plum Beach Improvements Phase 1 are completed. See photos at the link above. Brick pavement was installed along with composting toilets. With the hurricane gift of sand, Coco Plum Beach has a long ribbon of sand from the inlet toward Bonefish Tower. The usage of the beach keeps increasing from fishing, sightseeing, and even those occasional nudists. The eastern portion of the beach is kind of the de facto nudist beach like Haulover Beach up north. With the priceless ocean view, Coco Plum Beach is indeed impressive. Phase 2 will include boardwalks like Islamorada's Anne's Beach. Signage at the entrance and on US1 and Coco Plum Drive will direct beach goers to this outstanding passive beach and park.


Sk8 Club is under the ECMC umbrella. Sk8 Club representatives made a presentation for certain improvement to the Skate Park. They want to reestablish the Sk8 Club in the new Skate Park. They listed items such as picnic benches, revised gear policy, replace television and benches, replace the sound and public address systems, and install a television monitor for the bowl. Some gear policy suggestions were to allow helmet only for those skaters 15 or older and wrist guards for inline skaters 15 and older. The Sk8 Club indicated that they would provide the funds for events, promotions, and above improvements.

Schmidt said that city council would have to agree to the Sk8 Club improvements. He would first give the package to the city risk manager and legal to review. He also announced that the BMX Pro Lite bikes were allowed at the Skate Park exclusively from 4 to 6 PM Tuesdays through Fridays.

Publisher's editorial on Marathon Councilwoman Marilyn Tempest this November 16. These last few months we have observed the two new members of the Marathon City Council. Initially, we lumped Marilyn Tempest in with Pete Worthington, John Repetto, Scott Janke, Mike Cinque, and Joanie Nelson. As you might remember The Florida Keys Journal first endorsed Don Vasil, but after following the money that changed. We then endorsed Tempest. After a few meetings, we began to think that Marilyn was with the Repetto group.

Well, we just might be wrong about that. Although she makes some decisions and votes contrary to what we might think is right, she is not really in any one group. She is most definitely her own person and tries to represent all Marathon Citizens. We do believe she is more often wrong than right, but she is not beholden to anyone but the citizens. So we must put her in the independent category. That is really not all bad. Now if she will just vote our way.


Pete Worthington talked a good game, but more and more he has gone back to the same old Pete. This isn't unexpected, but still disappointing. We do believe that he tries his best, but that is not good enough sometimes.

Overall, though, we can be very thankful that the current city council does serve the best interest of Marathon's citizens notwithstanding some odd votes for some odd stuff that is contrary to common sense at times.

Well, there you have it, a random look at 2006. Now let's move on to 2007.

Marathon and the rest of Monroe County has entered into high season where a left turn is nigh on impossible. I just go ahead and turn right to find an easy left to go the way that I wanted to go in the first place. It seems that all lanes are full 24/7 with traffic, and everyone is in rush to get somewhere. The tailgaters are really notorious along with those who can't go slow enough for those who can't go fast enough.

At some point, unfortunately, old US1 claims more victims. People are maimed and killed. US1 is an accident waiting to happen. Just take a look at these pictures of one such accident: http://MarathonJournal.US/journal/press/index.htm.

The Marathon Near Shore Waters Advisory Committee held its regular meeting January 4 in the Marathon Public Library conference room. Photos are available at http://MarathonJournal.US/journal/press/index.htm. Chairman George Garrett led everyone in the Pledge of Allegiance.

After the December minutes were approved, the committee launched into a long discussion on the two-day lobster season. Different areas of the Keys have differing opinions. Some want to leave the season as is, while many others would like to do away with it altogether. FWC has the topic on its agenda for more research and input. While nothing seems imminent for a change, lobster tags may yet become a reality. Committee member Bennett Orr gave the report and led the discussion.

The new Boot Key Harbor mooring field installation may yet happen within a month or less. Harbormaster Richard Tanner reported to the committee. The ACOE permit is on track. The $100 check was sent yesterday. The mooring field survey was slowed by a change in personnel. Installation could start by the end of January. As former mayor Randy Mearns was wont to say, "Government moves at the pace of a dead snake."

The marina bath facility project is on track according to acting Harbor Manager C. J. Geotis. The engineering plan particulars are being tightened up.

Geotis also reported on boat ramp projects progress. The marina boat ramp is making no progress due to compensatory mitigation of environment impact considerations. The 33rd Street ramp has the engineering done. Marathon Public Works Department will put out an RFP as soon as a more detailed plan is created. Other boat ramp options are being considered, but none of those appear promising at the moment.

George Steinmetz wants Marathon and other government entities to encourage Florida Trails. They have been given all the old bridges, which places them under the park services. Efforts are underway to clean the bridges and provide management, enforcement, and improvements in repairs and maintenance of these old bridges. All associated agencies need to support the overall process so that all county and city residents can benefit.

George Garret reported that almost 450 boats have been removed from near shore waters throughout the county. The next meeting of this committee was scheduled for February 1 at 6:30 PM in the conference room at the Marathon Public Library.

FIRM's 12 Articles of Faith has been distributed in a number of ways. There is a special Florida legislative session meeting coming up this weekend, according to FIRM's Robbie Hopcraft at robbiekw@bellsouth.net. Insurance issues will be under intense scrutiny.

Middle Keys Community Land Trust board of directors met January 8 at the main City Hall conference room.Middle Keys Community Land Trust President Debbie Love reported that the "out of reach" figures for Monroe County are almost $20 per hour for a median rent level of $1,018 per 2 bedroom rental. That is the most in Florida. While these figures are indicative of the affordable housing crisis, $1,018 for a 2 bedroom is not anywhere near the median for Marathon. Just look in the latest affordable housing study for Marathon, the Comprehensive Plan, and the classifieds, and you will notice that 2 bedroom rents are way more than the median. Executive Director Rick Casey told the board that the Islamorada Woods Corner 16-unit project is in the final detail phase and ground will be broken soon. The Marathon scattered 5 sites have 3 cost estimates from the RFP. He stated that the CWHIP project for 84 to 103 units spread between Islamorada and Marathon has been submitted to the state. The Land Trust is 1 of 6 applications whereby 4 will be awarded.

Treasurer Josh Mothner presented the treasurer's report. The 2007 budget will be presented and voted on at the February meeting.

Secretary Tamara Lundstrom conducted the election of officers. The previous slate of officers were reelected. President Debbie Love, Vice President Morgan Hill, Secretary Tamara Lundstrom, Treasurer Josh Mothner.

The meeting adjourned so all the Gator and only 2 Buckeye fans could go home to the big game.

The Marathon City Council met January 9 at the Marathon Government Center EOC Room. Mike Puto hurt himself in a fall, and he is in the hospital. Acting City Manager C. J. Geotis took over for Puto.

Acting City Manager C. J. Geotis presented his report. Early concrete pours at the Marathon High School (MHS) is again an issue. Heery requested a start time of 5:00 AM in mid-March. Slab pours will take a long time during the day. The council approved the seven-day concrete pour schedule. Jerry Powers on Aviation Boulevard stated that Heery started pouring at 5:00 PM would mean that the cement yard [mixing] starts at 3:00 AM. Sean Cannon on Sombrero Beach Road doesn’t like starting early. John Whalton Grassy Key owns property across from the cement yard, and MHS construction good thing, but this is becoming a regular thing with ongoing and future construction coming online.

Sandler at Greater Marathon Bay Marlin Bay Yacht Club is getting a bay bottom lease from the state. Mitigation required garnered the city $80,000 and another $100,000 for waterfront access issues.

Special Master Tom Wright made a determination in an offshore island case. City Attorney requested a special call executive meeting to discuss the case. That was scheduled for January 7 at 1:30 PM.

City Attorney Jimmy Morales presented the monthly legal report. This report detailed the specific and general services rendered in staff support efforts, projects, and legal issues. The development of LDRs in Growth Management continued to strain the budget. Code Compliance was also running ahead of projected totals. Due to intense actions at all levels, the legal activity remained high for the city.

Citizens' comments: Fred Endemann live on Avenue I, site of Area 6 wastewater treatment plant. He objects to stop using the old plant. 64 floating household who depended on the old bathhouse. Is it really essential to demolish existing plant.

William Sampsel of Grassy Key said that 21 wounded vets were coming on their bikes this Friday 3:30 PM. He requested that the city help to honor the vets on bikes. He also ask, “Why isn’t the Grassy Key Fire Station issue is not on the agenda.”

John Whalton of Grassy Key was wondering if there was a set fee that the city has not been missing for impact mitigation funding from developers like Marlin Bay Yacht Club.

Resolution 2007-001 commended all those involved in the removal of storm damaged and abandoned vessels after the 2005 hurricane season. In particular, the city commended FWC and Monroe County Sheriff’s office for their efforts. The resolution further requested the continued aggressive efforts to minimize the existence of damage, abandoned derelict vessels. Mayor Chris Bull presented commendations to FWC, Monroe County Sherriff’s Department, and Monroe County Marine Resources Director George Garrett.

Council appointed no one to Firefighter Pension Board to fill the vacancy caused by Frank Greenman’s resignation. Greenman resigned over volunteer firefighter issues. This position will be re-advertised, since no one applied.

Habitat for Humanity requested a fee waiver of $6,300. Instead of paying for forms, permits, and documents, the money could go to affordable housing. Bruce Ferraro President of the Marathon Habitat for Humanity spoke about the request.

Council approved a minor conditional use permit for the development of an 84-unit affordable housing rental complex located about US1 and 71st Street. Staff recommended approval with time guidelines in place to recover the 84 allocations should the complex not be built in a reasonable time. The Planning Commission deadlocked over that very issue on whether the Carlisle Group could finish the Sea Grape project in a timely manner. CEO Lloyd Boggio assured the council that the project will be finished on time, but that he could not get financing with completion 12 months from permitting. After a long discussion Pinkus proposed that phase 1 be completed 18 months from permitting with a 12 month review; phase 2, 15 months from permitting with 9 month review.

Pigeon Key Arts Festival requested a fee waiver for alcohol sales and consumption in Phase II of the Community Park.

Ordinance 2007-01 created standards for utility permitting plus road and bridge construction and repairs.

Ordinance 2006-33 provided for a non-binding referendum ballot measure changing the month council members are elected from March to November. This ordinance essentially asks the voters if they approve of such a change. If the ballot measure passes, then the election date would change to November. At that time, then whomever is in office would all have their term extended several months one time only.


Resolution 2007-002 approved the market rate residential dwelling unit allocation for the period named.

Consent item, Resolution 2007-003, authorized the city manager to enter into amendment no. 2 to amendment H5M01 with FDEP Bureau of Beaches and Coastal systems to accept $145,728 in grant money.

Consent item, Resolution 2007-004 approved an interlocal agreement between Monroe County and the city for the county to assist in the aerial photographs development for use as a GIS layer. The cost is $30,000.

Consent item, Council approved the minutes for 11/14, 11/28, 12/12, and 12/21/06.

Resolution 2007-005 expressed appreciation to US Representative Ileana Ros-Lehtinen, 18th District, for her assistance in bringing back regional jet service to the Marathon Airport.

Resolution 2007-006 was about the disposal of old trucks 2004 Ranger and 2000 Mazda truck. The council approved the bids that were made.


Resolution 2007-007 gave support to FIRM’s effort with the state in legislative insurance reform.

Additional fire hydrants are sorely needed. The council directed staff to push that priority aggressively, considering the recent Grassy Key fire event. Councilman Worthington stated that the money was to com from Earthmark, about $75,000.

Affordable housing special call meeting was scheduled February 6 at 6:30 PM with the location yet to be determined.


Council comments: Councilwoman Tempest was concerned about the escalating spending. She wanted to slow down, change attitude, exercise fiscal caution. Worthington said that it was time to get back to work. More affordable housing was his priority. Councilman Pinkus hoped that the Carlisle project would move forward rapidly. He also talked to County Manager Tom Willi about possibly leasing the Marathon Government Center for city hall. Vice Mayor Mearns commended the city for selling bracelets for cancer. Her daughter has cancer again. Marjie Mearns herself was a cancer survivor. Mayor Bull reiterated her comments. He also commented that the Aviation Boulevard/US1 signal issue. He invited everyone to the big celebration of the return of regional jet service. Bull asked for and got $1000 from the council’s contingency fund to help defray celebration costs.

Citizens' comments: Danny Miller said that he represented the public over private interests, specifically the Marathon Yacht Club bay bottom lease. He was opposed to the lease. It doesn’t allow access to everyone in the public. Mr. Miller was clearly well spoken. He asked, “Will you sell the public’s interest for peanuts?”


Fred Endemann of Coco Plum was concerned that the mayor didn’t get any of his emails. The mayor directed staff to investigate.

Council and administration response to citizens' comments: The mayor explained that the wastewater treatment plant near Avenue I was not cost effective to continue to operate it for a short duration. The mayor assured everyone that the negotiations with the Marathon Yacht Club were ongoing, and the public interest was paramount.

FIRM goes to Tallahassee !!

FIRM members arrived in Tallahassee yesterday to continue our fight for Fair Insurance Rates In Monroe for ALL residents. FIRM members met with Rep. Saunders, who took us from office to office and introduced us to other state reps. We had very good interaction with the reps we met since no one else has arrived yet to start lobbying the legislature. Most of the state reps present were from south Florida and two of them are on the insurance committee.


Most importantly FIRM representatives have a meeting scheduled with house insurance chairman Ron Reagan. His assistant said she has received many e-mails from FIRM members about the insurance crises. (**Thank you FIRM members**)

FIRM members also met with Ken Sorensen and talked about the “use and file” status, he suggested we talk with Rep Dan Brown. Mr. Brown was not immediately available but we will try again to meet with him, that you can count on.

We talked with Bill Newton and set up a meeting with him for the following morning at 8:00am. He thought the Governor would agree to meet with us but we haven't been able to schedule a time yet. We did get the head of the insurance industry to agree to meet with our coalition.

FIRM has been working with other groups across the state who have organized to battle the same crises, we have joined forces together to form a much larger coalition. We need to get the attention of the state politicians and are letting them know that the insurance industry does NOT make the laws !!

Marathon Code Compliance Board met January 10 at the Sheriff's Aviation Hangar second-floor training room. Photos are available at http://MarathonJournal.US/journal/press/index.htm.

The hour before the regular start of the board was devoted to the annual indoctrination to review code board basics. The minutes were approved. Witnesses were sworn in.

Inspector Michael Storm presented the first case. Case C2006-0421 Harold and Sandra Beerbower and John Ballantyne owners of 1780 109th Street Gulf were cited for violations of the National Flood Insurance Program, illegal downstairs enclosure. Mr. Beerbower passed out his affidavit and presented his defense. While sympathetic to the respondent, the board find the owners in violation and gave them 60 days to comply. Board member Kevin Woodland voted no.

Inspector Storm presented Case C2006-0431 Adam, Gilbert, and Clare Angermann owners of 11335 6th Avenue Ocean. They were cited for exterior construction in progress without benefit of a permit. The board found them in violation and gave them 30 days to apply for an after-the-fact permit.

Storm presented Case C2006-0257 Daniel and Geraldine Cannon and Richard and Lisa Turner owners of 649 84th Street Ocean. They were cited for health and safety issues regarding two severely damaged mobile homes and a shed, and the property was in need of maintenance. Inspector Storm withdrew the case as the owners came into compliance.

Inspector Cynthia McPherson presented Case C2006-0209 Keys RV/Mobile Home Condominium Association and Daniel and Pamela Aldridge owners 6099 Overseas Highway Lot 67 West. They were cited for repair and replacement of a dock without a permit. The board found the owners in violation and instructed that they come into compliance immediately. This decision passed 5-1.

Inspector McPherson presented her second case. C2006-0409 Grant Avery owner of 121 Mockingbird Lane was cited for an expired permit for hurricane shutters. McPherson withdrew the case, as the owner had come into compliance.

Inspector Michael Storm presented the next case. Case C2006-0291 Barbara Cook owner of 10980 3rd Avenue Gulf was cited for a structure placed on the property without a permit. The board heard from her contractor. Based on the information presented, the board granted a 60 day extension.

Inspector McPherson provided a status report on Case C2006-0125 Larry Breedlove owner of the commercial vacant lot adjacent to 13900 Overseas Highway. He was cited for removal of vegetation, illegal land clearing, and placement of fill. The owner still is not come into compliance. The city will bring the owner up for non-compliance at the February board meeting.

SOS Foundation met January 11 at Marathon City Hall Annex conference room. While I am on the board of directors for this non-profit group, I have been following this story for quite some time. I have had a number of reliable sources local and state keeping me current on the Old Seven-Mile Bridge and Pigeon Key.

Marathon Vice Mayor Mearns has been a passionate advocate for retaining the historic appearance of the bridge and keeping Pigeon Key viable for all county residents. Yet now she has run into Monroe County machinations that seem uncalled for, come out of no where apparently, and are unforgivable. Frankly, after the Tom Willi email to the Mayor providing background for a Cay Clubs takeover of the whole operation, the guano hit the fan.

If you have a situation that walks, talks, and quacks like a duck, then you have a duck! Super Mayor Mario Di Gennaro has been caught red-handed. And the fact that a mere woman called him to task has Super Mario up in arms and ready to do battle. Over what?

For the benefit of all county residents, the bridge and Pigeon Key need to remain under the capable and proven management that has brought nothing but international praise and recognition. What part of an historic masterpiece does Super Mario not get? Mr. Monroe County Mayor, I think that you would do well to get your budget and unruly manager under control. Let the experts take care of the bridge and Pigeon Key.

FIRM continues the fight in Tallahassee on day 2
FIRM representatives Cindy DeRocher & Donna Moody started the day in the Senate Insurance committee meeting where they were given time to speak to the committee. FIRM, and other consumer groups, HAC, and FCAN all spoke on behalf of consumers. Next came a 3 hour meeting reviewing the proposed changes to the new senate bill.

FIRM then had a meeting with the AFL-CIO; they are joining forces with the “consumer coalition”.

FIRM joined FCAN, HAC, AFLCIO, and PERG for the press conference to announce the consumer coalition group joining together. Together we have over 250,000 members.

FIRM representatives met with Representative Saunders and Representative Reagan (the house insurance chair).


We also met with Governor Charlie Christ, who expressed how much he needs our consumer groups to help him. He listened to our ideas & solutions with enthusiasm. AARP representatives joined us at this meeting. Several members of the media were present at the meeting so we should get some great press all over the state. We scheduled a meeting with Gov. Christ's assistant for tomorrow at noon. We really believe he is sincere about listening to the people to solve this issue. ….Very smart Guy !!

We met with Bruce Douglas the COB at Citizens Property Insurance while we were waiting for the Governor's meeting. The new Senate bill gives CPI permission to sell homeowners insurance to us. Hopefully this will bring down the overall cost of our insurance having it as one policy.


Then came a meeting with Senator Posey the chairman of the Senate insurance committee. **** He is getting FIRM member e-mails. **** He feels the insurance industry took advantage of the “use and file” law passed last year. This means the insurance companies lobbied with the “intention” of having the freedom to raise rates by only 5 to 10 %. Then, 2 weeks after the law was passed. State Farm raised their rates 70%. We shared our Florida Peninsula Ins. stories. Sen. Posey does understand that homeowners and businesses cannot take on anymore insurance cost without a negative economic impact to the state.


FIRM also met with Senator Fasono and Senator Storms (she is a freshman and on the insurance committee).

Tomorrow FIRM reps. have a consumer coalition strategy meeting with AFL-CIO. They are getting us help with their lobbyist. We did meet with the governor's assistant Chanta Combs, Kevin McCarty, Sam Miller (the head of the insurance industry) and hopefully now that more representatives from FIRM, Heather Carruthers & Al Sachs are in Tallahassee, more state reps. and senators will get to hear our message !!!

--International institute recognizes bridge project with Award of Merit--
 
BIG COPPITT KEY– A Florida Keys Overseas Heritage Trail bridge engineering project, which is managed by the Florida Department of Environmental Protection’s (DEP) Office of Greenways and Trails (OGT), was recently presented an Award of Merit from the International Concrete Repair Institute. The Trail project was recognized for an innovative technique used to repair and rehabilitate the historic railroad bridges on Big Coppitt Key.  
 
“We are pleased and excited to see worldwide recognition given to a creative engineering venture that enhances the safety of the Florida Keys Overseas Heritage Trail,” said Jena Brooks, Director of OGT. “Through this project we have increased the structural soundness of the bridges as well as helped preserve the historical integrity of the trail as a whole.”
 
The OGT contracted with Coastal Gunite Construction Company to use carbon fiber reinforced polymer bars to strengthen deck panels on six bridges. The bars increase the flexural strength of the deck panels through a more efficient installation process and prevent corrosion. The Florida Keys Overseas Heritage Trail bridge project was one of only ten projects selected worldwide to receive the 2006 Award of Merit, presented annually by the International Concrete Repair Institute to recognize outstanding projects in the concrete repair industry.
 
The historic bridges that were built early in the 20th century for railroad developer Henry Flagler’s Overseas Railroad are now an integral part of the multi-use bicycle and pedestrian Florida Keys Overseas Heritage Trail. The OGT currently maintains 42 miles of existing trail and bridges. The remainder of the 106 mile trail, which will link the 32 island chain from Key Largo to Key West, is presently in the design phase with construction to follow.
 
The Office of Greenways and Trails manages eight state trails, including the Marjorie Harris Carr Cross Florida Greenway, Florida’s longest green corridor stretching 110 miles from the St. Johns River near Palatka to the Gulf of Mexico. DEP, through OGT, also maintains five rail-trails, which are railroad tracks restored and converted to recreational trails for hiking, biking and skating. Through Florida Forever, the state’s premier land acquisition program, $4.5 million dollars is spent annually to purchase land for future trail areas and build and maintain Florida’s greenways and trails.

Introductions were made. Notables in attendance were Florida Scenic Highway Coordinator Charlene Wylie, Florida Keys Overseas Heritage Trail Outreach Coordinator Christina Lindley, a Marathon City Planning Department representative, Deputy Marathon City Manager C. J. Geotis, Marathon Vice Mayor Marjie Mearns, Coco Plum Representative Lynda Berrigan, Judy Hull, Carolann Sharkley, and Carol Miller [former Marathon Councilman Bob Miller's wife].

The organization elected officers. Judy Hull was elected president. Carolann Sharkley was elected as a board member, while Carol Miller was elected as treasurer. Lynda Berrigan was elected to the board.

Various grants will be needed. Everyone was asked to research grants for their various areas of concern at http://www.bywaysonline.org.

Subcommittees gave various reports dealing with the National Scenic Byway Grant Cycle, the status of the grant from the Bureau of Invasive Plant Management, the SHRIMP Award, the status of various trails but more importantly the US1 corridor, the status of getting helpers for a booth at the upcoming Green Living Expo, and general announcements from members. SHRIMP allegedly stood form Scenic Highway Remarkable Interpretative Management Program. The Green Living Expo booth will be at Marathon's Switlik School March 31.

The decision was made to help group meetings monthly throughout the three regions of the Keys. The main membership meeting would be conducted quarterly.

The Florida Keys Scenic Highway is sponsored by the FHWA National Scenic Byways, FDOT District 6. The Florida Keys Overseas Heritage Trail is Sponsored by the Office of Greenways and Trails, FDEP.

Overseas Village Home Owners Association [OVHOA] board of directors met on site January 17. November and December minutes were approved.

The 2007 budget was finalized and explained. The OVHOA financial position is good with reserves for unforeseen contingencies. The loan from the Middle Keys Community Land Trust will be paid off soon.

There were no amendments specified for the upcoming annual meeting on February 21. Other agenda items were discussed. The annual meeting will be a community and family affair rolled into official business.

The home owner document change for common property tax shares ballot was approved along with the shares being applied retroactively.

Other items for repair and/or maintenance were addressed. The meeting adjourned at about 7:00 PM.

Florida Keys Journal dropped off a business card at the Marlin Bay front office off US1 and 39th Street. Once again, in the interest of fairness, something Sandler at Greater Marathon Bay never considered, I gave this company a shot at answering to their problems. I have done this several times monthly, but Marlin Bay Yacht Club can't stand any kind of scrutiny.

Buildings go up rapidly. Seawalls are finished, as far as I could see. Big boulders line the seawall on the bay side. Men swarm all over the property with the rumble of engines in their ears.

Fortunately, the market is changing. There appears to be a glut of such projects all over the county. Maybe the ghosts of Gulfstream Trailer Park and Marina will rest easy yet. Just maybe justice will be done.

Cay Clubs misses mandatory publicly noticed FDOT meeting for Pigeon Key ferry service RFP today, January 19. The location of the gathering was the FDOT building. The county staff placed the notification ad and conducted the meeting. The mandatory meeting was hosted by County Engineer Dave Koppel at the Marathon Government Center. Local sources tell Florida Keys Journal that Super County Mayor Mario Di Gennaro was "furious" about not being told about the FDOT meeting. He was more upset that Cay Clubs Frank Rego missed the important meeting.

After learning that Florida Keys Journal knew about County Manager Tom Willi's email to Super Mario detailing strategies to get the Pigeon Key Foundation off the island by hook or crook, it appears that the county Mayor tried to mend fences with the Marathon Vice Mayor according to local sources. If the county Mayor would back off, then the imposing Marathon Vice Mayor would back off and even tender a pseudo apology. That apology showed up in a recent Keynoter.

It is common knowledge that Cay Clubs can't wait to take over Pigeon Key. Now, let's connect the dots. Super Mario is chummy with Cay Clubs Frank Rego. They want the Pigeon Key RFP for the ferry service. Cay Clubs wants to take over the island, and so does Super Mario. I guess now we know why Super Mario was furious. What stinks in Mario-land?

The Marathon Airport Task Force met January 23 at 1:30 PM in the airport departure lounge. County representatives Peter Horton and Reggie Paros were on hand to run the meeting and answer questions. Peter Horton reported that David Rice was unable to make the meeting due to a scheduling conflict. Rice is still very much involved in the process. Other notables were Monroe County Mayor Mario Di Gennaro, Cay Clubs Frank Rego, Marathon Mayor Chris Bull, and Vice Mayor Marjie Mearns.

Horton reported that TSA is on board as was demonstrated by the plastic-covered equipment in the aisle leading to the departure lounge being guarded by a Monroe County Deputy Sheriff. The TSA equipment is "gleaming and brand new," according to Horton.

Boyd Group Mike Mooney stated that Delta Airline Planner Amy Martin provided booking figure for February and March as 39% and 40% respectively. There is also no effect on the Key West Airport Delta bookings. Mooney said the Gulfstream President Dave Hackett is still very much interested in Marathon Airport, but sent a letter releasing the mitigation funds. That way other airlines can be pursued once the FAA approves the extra existing runway needed. This approval process is ongoing.

Peter Horton itemized progress on a number of items. The county resolution detailing ground transportation rules was in effect. Food service will require an RFP, until then beverages and snacks will have to suffice. Promotion, media, and marketing are ongoing concerns being addressed by Harold Wheeler at the TDC. The Welcome Center will most likely be run by the Marathon Chamber of Commerce but anyone can become involved in that project. One minor controversy, if you could call it that, is the fact that the signature Blue Marlin on the east side of the terminal will have to be moved. The emblem of the Florida Keys will find a new home so that everyone can enjoy the sight.

A press conference is scheduled for February 12 at 10 AM. The inaugural flight arrival and celebration starts at noon February 15. The first flight is scheduled to land at 12:35 PM. The next Marathon Airport Task Force meeting is scheduled for March 27 at 1:30 PM at the Sheriff's Marathon Aviation Hangar 2nd-floor training room.

Cay Club’s Frank Rego and Monroe County Mayor Mario Di Gennaro met with me [Florida Keys Journal owner/publisher Larry Shaffer] at the mayor’s request. We assembled in the mayor’s office. He closed the door. They took me to task over my opinion piece on Pigeon Key going to Cay Clubs. Mario told me that he never met Patty Ivey and didn’t know about her until today. Frank Rego talked about attorneys. He has good ones, but I have better ones. So? Essentially, they both refuted the entire opinion piece. 
 
I offered them free space to rebut my opinion article. That is fair. Still, I stand by my local sources. The email in question does exist. I’ve seen it, even though Mario called his assistant Tamara Lundstrom into the office to deny its existence. I plan on providing a copy to interested parties and Mayor Mario. Perception as to what it
means is always in the eye of the perceiver. After consulting with my sources, the line about Patty Ivey may be incorrect. I corrected the original article, which appears at http://MarathonJournal.US/journal/2007/020107.htm#Cay Clubs misses_mandatory FDOT meeting.
 
The bottom line is that Pigeon Key Foundation should remain caretakers of this national historic treasure. Pigeon Key and the old seven-mile bridge belong to all county residents. Developers, however well intentioned, should stay out of this historic arena. Frankly, I don’t think they should bid for the ferry service RFP either, but let’s see what happens here. 
 
The meeting ended on a friendlier basis. I’m going to write what I know about based on the best information that I have from my sources. Frank Rego and Mario Di Gennaro asked that I call them about what I might or might not have in the way of questions and whatnot. They would like me to ask them about such things. That’s fair, now that I have met both individuals. I’m still going to write about such things though. Someone has to ask the hard questions. I’m not afraid to do that. Are you afraid?

City Manager's Report: On Saturday, the city dedicates the new batting cage at the Community Park. Mike Puto is hiring more firefighters and taking other measure to improve fire service to Grassy Key. Heery building the new MHS finished the latest rounds of concrete pours. Heery indicated that they will no longer fight the timing issue and start the Cemex plant at 6 AM and start future pours at 7 AM.

City Attorney Jimmy Morales reported the creation of the Unsafe Structures Board. He told the council to be prepared to give policy guidance on procedures and so on. He requested that the council set the administrative fee to $400, which is the amount that it takes for staff to process a typical case. The council approved that request.


Morales also reported that the Jolly Rogers litigation case is going to be dismissed by the complainant.

Community Services Director Susie Thomas reported on the funding in place for the City Hall / Library Construction Manager at Risk project. She gave the council members a short list for the RFP for construction manager at risk. Jeff Pinkus reported on possibly using/obtaining the county government center for use as city hall. The entire building would meet the square footage needs. With $150,000 paid in rent monthly, the city could save a lot of taxpayer money. Marilyn Tempest asked to investigate other options. The minimum requirements are 15,000 square foot and must meet at least 150 MPH wind load.

The council still ranked three contracting agencies for the City Hall / Library Construction Manager at Risk project. Presentations were present by Biltmore, Coastal [doing Marlin Bay Yacht Club], & Dooley Mack Construction. Biltmore Construction won the rankings by just a few points. Only a few points separated all three.

Resolution 2007-08 authorized the city to contract with Biltmore Construction as construction manager at risk for the City Hall/Monroe County Library construction project. The RFQ process by Monroe County Engineer Dave Koppel, Deputy City Manager C. J. Geotis, City Construction Manager B. W. Sprague, and Community Services Director Susie Thomas examined several contractors.

Citizens' comments: William Sampsel of Grassy Key wanted to put a time limit on solving fire service problems. He also thanked everyone for helping with the disabled bikers. Gene Kibbing bemoaned the fact that the Boot Key Harbor moorings have yet to be completed, the bike paths are not cleaned or maintained, Sombrero Boulevard needed repaired, 53rd Street improvements are not started, the JGT bus parking is not in the right place, and that this was his farewell speech. Fred Endemann of Coco Plum asked why the city could not maintain the old wastewater treatment plant. O. T. Atkinson of Coco Plum questioned the charter legislative intent that was supposed to improve safety health and welfare of residents. He opposed closing the old wastewater treatment plant. Sean Cannon reported that the Heery trucks showed up at 5 AM with the generators and lights show up at 4 AM. At 7:45 AM they start the cement pours. They are almost done with the pour at approximately 10:30AM and completely done by 4 PM. Jerry Powers on Aviation Boulevard can live with the Cemex cement plant starting at 6 AM, and he thanked the council for all their help. John Roddermocker on Avenue I thanked the council for the new wastewater treatment plant plans, but he wanted them to leave the old plant.

WEC Engineer Mike Hatfield, Deputy City Manager C. J. Geotis, and Community Services Director Susie Thomas reported on the old wastewater treatment plant. They talked with residents several times. The way the old plant was placed prevents building the new plant around it. Due to its shape and other smaller reasons, the liability was too great. The plant must be decommissioned. The restroom was not hooked up for many months. The affluent disposal was available through a holding tank, which was not convenient but necessary. The council voted to proceed with the old plant being decommissioned. Tempest was the lone no vote.


Ordinance 2007-02 repealed Ordinance 00-09-08 regarding the collection and disposal of solid waste within the city corporate limits. The county contracts to provide this service.

Ordinance 2007-03 amended and restated Chapter 9.5 the LDRs of Marathon Code. This ordinance also deleted Chapter 19 Miscellaneous LDRs of Marathon City. Fred Gross presented an overview of each chapter. Lynda Berrigan of Coco Plum Home Owners Association used 10 minutes to ask that their single-family community in Coco Plum be preserved and protected. She went through specific requests for her community. Mark Smith, Bob Liar, Jeff Stockheart from D’Asign Source, Paul Joseph, Phil Snoburger, Alan Levitt of Coco Plum, all made specific requests of the council. The council decided that there might be a need for a workshop just on dock issues.

Ordinance 2007-04 amended the entire Marathon Land Use District (Zoning) Map and provided for a revised Land Use District (Zoning) Map. Initially, Jeff Pinkus objected to making changes to the map to avoid a cost to a potential applicant. He was against granting changes for developers. Jeff Pinkus and Fred Gross were at odds over directions given at the Key Colony Beach City Hall workshop. Mark Smith, Barbara Mitchell of the Craig Company, Brian Schmitt, and Sandra Walters all made specific requests. Fred Gross ran down the list of proposed changes, while City Planner Jacqulyn Walters pointed out the various locations on the map.


Ordinance 2007-01 created Section 16-8 Standards for Utility Permitting, Road, Bridge Construction, and Repairs.

Consent item: Resolution 2006-189 approved the Memorandum of Understanding and preferred provider agreement with Fisherman’s Hospital. Marathon Fire Rescue Department will provide medical transport services to the hospital.

Resolution 2007-09 approved a minor conditional use permit for the development of a 84 unit affordable housing apartment complex, located on Overseas Highway at approximately 71st Street Ocean. The item was removed from the consent agenda by Worthington to ensure that there is a fire hydrant on US1. The council instructed the Fire Chief to make a hydrant on US1 required.

Consent item: Resolution 2007-10 authorized the city manager to enter Project Agreement No. 2 with B. W. Sprague for construction manager services for the Marathon City Hall/Monroe County Library combination building.


Consent item: Resolution 2007-11 nominated acquisition properties for the Monroe County Land Authority for affordable housing.

Resolution 2007-12 directed the Planning Department to defer processing of development applications, the issuance of development approvals for the redevelopment or conversion of mobile home parks, and requests for land use district zoning map amendments from Urban Residential Mobile Home (URM) and Urban Residential Mobile Home Limited (URM-L) to any other land use zoning district designation. This policy continues until the new or amended land development regulations are adopted by the council or until 270 days from January 23, 2007, whichever occurs first.

Resolution 2007-13 approved an interlocal agreement with the Florida Keys Aqueduct Authority for billing services for all of Marathon wastewater accounts.

Consent item: Resolution 2007-14 proclaimed February 2007 to be Water Quality Awareness Month within the jurisdiction of Marathon, Florida.


Consent item: Resolution 2007-15 ratified the acquisition of certain real property in the city to serve a public purpose, specifically to build a wastewater treatment plant for service area 6.

Consent item: The council approved the minutes for 1/9/07

Fire station information included the required 195 mph wind load provision. Susie Thomas also reported that the project is doing well financially.

The council meeting adjourned well after midnight.

What's Happening! I got to meet the mighty Mario Di Gennaro. He is the current Mayor of Monroe County. His friend, Frank Rego, is a VP for Cay Clubs. They both were a bit unnerved by my opinion piece. The meeting started out rough, but ended a bit better. I wasn't going to be tortured, stopped, intimidated, and scared.

Miscellany: I am watching the Marathon election campaigns ramping up. This is going to be a very hard election season to pick 2 viable candidates out of a field of 6. They are all very good. This will be the best election year yet in my estimation. So you got to vote to be counted. If you don't vote, you don't count!

Finally: Did you know that Rhode Island's state bird is the Rhode Island Red? The flower is the Violet. The tree is the Red Maple. The capital is Providence. Statehood was granted May 29, 1790. The Original Marathon Seafood Festival is coming up early in March. Save up your nickels and dimes and get over to the Community Park to enjoy a Marathon staple. Otherwise, this month was a good beginning on 2007.

Orange TomCat that Kitty liked!Ebony: Make Abby into a skunk cause she smells. But I don't ever get my way. Plus now everyone is calling me fat. I don't care for that. So what is my belly drags on the floor picking up dust bunnies? Dang old dust bunnies are no real bunnies you can chase and play with and eat. I would be just dandy with lizards, hot lizards, but it been so cold lately nothing good to eat is even warm enough to chase and catch, let alone ingest. I laid right there on the sidewalk, which was even cold. My old lawn chair on the porch was cold. I just come inside and sleep. Then human bean wake me up chasing that skunky old Abby around trying to put flea stuff on. I don't even fuss no more when yuckly flea and tick stuff applied to me. I can handle that mean thing. >^..^<
Abby: I think you that Ebony is two ears short of bunny breath, I do. I getting the same old teasing about getting fat too, but at least I don't catch no dust bunnies. I can't help that I meow repeatedly for nummies I nose is in the kitchen cabinet. I would open it with my paw, but it is hard to do. Human bean will open most anything we scratch or paw tap on, but he is not friendly with letting us in the cat storehouse of nummies, yummies, catnip, etc. >^..^<

Ebony: A thank you to human bean for replanting the Plumeria branch I broke off the Plumeria tree thing on the porch what the human bean loves more than Abby any day. If I could stay outside all the time with Abby inside, then it would be cat Christmas for me all year long, but no that Abby have to come out and nose around. >^..^<
Abby: I liked to bat you around, Ebony, like the paper wads and bottle caps that human bean throw on the floor for me. Lately, he has been twirling strings around for us. We both chase them like deranged kittens, we do. I even got so excited that I ran head first into the wall. That hurt, but catnip made it feel all better then. >^..^<

Ebony: Abby, you just as bad as that Christmas present we got that is noisy and a bit scary. It is the dinosaur toy that walks and grabs things in its plastic teeth. I don't like it much. Neither do Abby, I expect. It doesn't have no sense of direction. You paw tap it and it go somewhere else bumping into walls too. >^..^<
Abby: Human bean been putting catnip on our new scratching pads, but I still like to destroy the carpets. Human bean making funny noises when I do that too. He even spritzed me with water once. I don't know why. >^..^<
Ebony: Abby, you do well to just be my bed buddy and stay out of trouble. I saw how human been holler at you for scratching his new office chair what he forgot to cover from you destructive ways. Now if you don't like raw chicken, you don't get into that kind of trouble. But Abby likes raw chicken and it makes her crazy. >^..^<
Abby: 
Ebony, I like chicken, but I don't like when human bean wants to trim my claws. He got this machine that is scary and make me shiver with fear some not a lot but some, you nose. I rather rub on a hot sidewalk. >^..^<

Ebony: I see how you change the subject all the time. I would rather sleep inside the armoire but now you do that too. There can't be two cats what not like each other in that a small space but you do it any old way. At least you don't come into my pet carrier with my catnip. I growl and snap at you if you do, Abby. >^..^<
Abby: All I got to meow about is that I got taken to the office and didn't like it. Just because you like to go meet people don't mean that I do. I'm anti-people. Just so human bean would notice, but he don't. >^..^<
Ebony: I'll go riding in a truck or a car or go visiting anytime so long I get away from you once in a while. You just don't know how much I dream of pushing you off the wall near the Plumeria tree. I don't care if I broke it. >^..^<
Abby: Ebony, you don't even know how to dream. When I dream, I twitch and my whiskers move around. My eyes roll around all over the place. You know how I nose that? Human bean tell me everything. Well, all you cats and peoples out there, just remember that dogs can be run over by a car. It don't hurt my feelings at all! >^..^<

Internet Stuff
Here are the latest DVD films from http://www.NetFlix.com:

  1. Factotum is an independent film, quirky and compelling. The movie follows one man through a period in his life that focuses on writing, drinking, gambling, and women. He has one job after another and goes through women, sometimes the same ones, repeatedly. Through it all, he continues writing. He slowly allows the street existence to take over his life. While the film is not expertly made, the story still comes through.

  2. The Wicker Man didn't scare me very much, but I was captivated by the plot. The background, the characters, and a great story helped make this movie appealing. I just wanted to get to the end, so I could see what was going to happen. I expected the unexpected and wasn't disappointed.

  3. World Trade Center was one movie that I was not looking forward to reviewing. Since that day, now receding rapidly into history, I have not really dealt with the horror, the real men and women involved, or how the whole episode had affected me personally. Like many, I watched television helplessly not knowing how to feel, what to do, or even how to mourn. I watched this film, and watching the story unfold was what I needed. If you haven’t seen this movie, please do. There is a certain healing involved, some understanding, and a lot of grief.

  4. With this version of Miami Vice you certainly get what you expect. The film has good acting, nice action, and a decent plot. The movie entertains and is worth watching. I expected a better score and maybe more action, but I wasn't disappointed.

  5. Little Miss Sunshine was very close to a 5-star film. A family takes a life-altering trip to ensure a little girl gets into a beauty pageant. The events up to the pageant and including that as well alter each family member's perception of each other, self, and the family. This is a warm, naturally funny, and well made film. Everyone will enjoy the movie, even if there are some adult elements. The characters grandpa, the uncle, the son, the full-of-life daughter, and the parents make this a must see.

  6. The Illusionist is beautiful in design and intent. The acting is enjoyable and free. The plot is just right. If you pay attention, you might guess what is coming next. How it all ends is up to you.

  7. The Devil Wears Prada is an excellent film. The acting is high caliber. The story is solid and real. I thoroughly enjoyed this movie. I give this movie 5 stars. The film is well worth watching repeatedly.

  8. The Night Listener is a surprising movie from a surprising actor, Robin Williams. In a sensitive subject, the story plods along building a tension and some dread. The film maintained a dark mood and moved along quickly even though there was little action. You sense something wrong, some kind of psycho thrill. While the movie wasn't deep and lacked action, the plot was decent enough to keep your interest. I liked the film just to see Robin William do some serious acting. He was good too.

  9. The Last Kiss moves way too slow to keep your interest. That is a shame, because the film is all about relationship from new, over heated, and the forever marriages some have. The main two characters are wonderful together. I like romantic comedies, but I had to force myself to sit through this one. The last half of the movie is much better than the first half.

  10. The Ron Clark Story I have seen before, but seeing the movie again was rewarding. I like stories of success. Ron Clark takes teaching to new levels and with kids everyone else have given up on. His success is just as enlightening as the success of each of the kids that he nurtures and teaches. I liked the film for the good acting, the realistic approach, and the feel-good atmosphere. We don’t have enough of that in movies of late.

  11. The Guardian is a tribute to all Coast Guard swimmers/rescuers. The story starts with a senior chief who is the survivor of his crew from a rescue gone wrong. Then the senior chief goes to the school for swimmers/rescuers. There he meets a younger version of himself. Eventually, the conclusion ties their lives together in a climatic ending. I liked the movie, and it was a very entertaining 2 hours.

  12. Quinceanera is a unique film with one-of-a-kind characters. Teens struggle to get to adulthood in a culture that can hold them back. Through the entire plot, you identify with people and their situations. This is a tribute to life and those loved ones who make a difference.

Hockey Puck
NHL: The Florida Panthers finally won a blow-out game against someone. Sorry to all the Pittsburgh Penguins fans. The Florida Panthers defeated the Washington Caps in NHL play. The Panthers knocked off the Jersey Devils.

PGA: Tiger Woods is doing well in the Buick Open.

NASCAR NEXTEL: Daytona is finally around the corner. Another great NASCAR season is coming.

NBA: The Miami Heat finally ended their losing streak with an impressive win over the Portland Trailblazers. Dwayne Wade came back from injury to lead the Heat to the victory. The Miami Heat won a second game in a row over the Seattle Supersonics. The Miami Heat won their third game in a row over the Golden State Warriors. The blowout victory got the Heat back in the playoff picture. The Miami Heat won their fourth in a row over the Utah Jazz. The Miami Heat beat the Indiana Pacers to get closer to the 500 mark.
The Miami Heat without the Shaq or the Flash [Wade] still beat up on the New York Knicks.

NFL: The Miami Dolphins got a new coach. Next season has some hope to it. Patriots and the Bears in the Super Bowl. I like the Bears.

MLB: Nothing to report in baseball, as if we are not bored enough.

WTA: Serena Williams won her eighth open at the Australian Open.

NCAA Football: The BCS Championship game saw Ohio State Buckeyes lose badly to the Florida Gators. Ohio State fans suffered, but there is always next season. Boo on them Gators, I say.

Book Three Twins of the Dark Star
Book One Tears from Ao, Book Two The Mountains of Ao and four poetry collections, Pages of Life, Visions of Life, Moments of Life, and The Book of Kalian Mysticism are available at http://RunesofAo.com/aobp/. The Runes of Ao project is ongoing. Book Three Twins of the Dark Star novel is in the outlining phase and will most likely take a while as the complexity of the Ao series increases.
